1. Acceptance of Terms

By downloading, installing, or using Monaza, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Eligibility

You must be at least 13 years of age (or the minimum age required by applicable law in your jurisdiction) to use Monaza. By using the Service, you represent and warrant that you meet this requirement.

The Service is available worldwide except where prohibited by applicable law. You are responsible for ensuring your use of the Service complies with all laws and regulations applicable in your jurisdiction.

3. Account Registration

To access most features of Monaza, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration

• Maintain the security of your password and account credentials

• Notify us immediately at support@getmonaza.com of any unauthorised use of your account

• Accept responsibility for all activities that occur under your account

You may register using your Apple ID, Google account, or email address. Tumaio is not responsible for any loss arising from your failure to maintain the security of your account credentials.

You may not create accounts using automated means or for speculative or fraudulent purposes, and you may not use another person's account without permission.

4. The Service

Monaza is a personal finance management application that allows you to manually track your financial accounts, expenses, income, debts, investments, and net worth. The Service provides tools for budgeting, financial forecasting, and portfolio tracking.

What Monaza Is Not

• Monaza is not a bank, financial institution, or payment processor.

• Monaza does not hold, transfer, or manage your money.

• Monaza does not connect to your bank accounts or access banking credentials.

• Monaza does not provide regulated financial advice, investment advice, or tax advice.

Service Availability

We strive to maintain the Service at all times but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice where practicable. We will not be liable to you for any modification, suspension, or discontinuation of the Service.

5. Financial Information Disclaimer

Important: The financial projections, forecasts, calculations, and insights provided by Monaza are estimates based solely on the data you manually enter. They are provided for informational and educational purposes only and do not constitute financial, investment, legal, or tax advice.

You should not make financial decisions based solely on information displayed in Monaza. Always consult a qualified financial advisor, accountant, or other professional before making significant financial decisions.

Tumaio makes no representations or warranties about the accuracy, completeness, or suitability of any financial information generated by the Service. You assume all risk for decisions made based on information from the Service.

6. Subscription & Payment

Free Tier

Monaza offers a free tier with limited features. No payment information is required to use the free tier.

Paid Subscriptions

Monaza may offer paid subscription plans ("Pro") that unlock additional features. Subscriptions are billed on a monthly or annual basis, as selected at the time of purchase. By subscribing, you authorise us (or our payment processor) to charge your selected payment method.

Cancellation

You may cancel your subscription at any time through your device's app store account settings (Google Play or Apple App Store). Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except where required by applicable law.

Price Changes

We reserve the right to change subscription prices. We will give you at least 30 days' notice of any price changes. Your continued use of the Service after the price change takes effect constitutes your agreement to the new price.

Refunds

All purchases are final and non-refundable except as required by applicable law or as explicitly stated in our refund policy. For refund requests, contact support@getmonaza.com.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation

• Impersonate any person or entity or misrepresent your affiliation

• Attempt to gain unauthorised access to any part of the Service or its related systems

• Reverse-engineer, decompile, or disassemble the app or attempt to derive its source code

• Transmit viruses, malware, or other harmful code

• Scrape, crawl, or extract data from the Service using automated tools

• Use the Service for any fraudulent, harmful, or illegal purpose

• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate your access if you violate these provisions.

8. Intellectual Property

Our Property

The Monaza app, including its design, code, text, graphics, logos, and all other content (excluding your data), is owned by or licensed to Tumaio, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written consent.

Your Data

You retain ownership of all financial data and information you enter into the Service ("Your Data"). By using the Service, you grant Tumaio a limited, non-exclusive, worldwide licence to store, process, and display Your Data solely for the purpose of providing the Service to you.

You may export or delete Your Data at any time through the app settings.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant Tumaio a non-exclusive, royalty-free, perpetual licence to use and incorporate such feedback without obligation to you.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using Monaza, you consent to the collection and use of your information as described in the Privacy Policy.

10. Termination

By You

You may terminate your account at any time by deleting your account through the app settings or by contacting support@getmonaza.com. Upon deletion, your data will be removed in accordance with our Privacy Policy.

By Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms or if required by law. We will endeavour to provide reasonable notice where practicable.

Effect of Termination

Upon termination, your right to use the Service immediately ceases. Sections 5, 8, 11, 12, 13, and 14 will survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TUMAIO DOES NOT WARRANT THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TUMAIO, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the Service

• Any financial decisions made based on information from the Service

• Unauthorised access to or use of our servers and/or personal information stored therein

• Any interruption or cessation of transmission to or from the Service

IN NO EVENT WILL TUMAIO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO TUMAIO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Tumaio, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law & Disputes

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Informal Resolution

Before filing any formal legal claim, you agree to first contact us at support@getmonaza.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Arbitration

If the dispute is not resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Delaware, United States, unless both parties agree otherwise.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as a class or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Exception

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" at the top of this page, by sending an email to your registered address, or by displaying a notice within the app at least 15 days before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
